WARRANTY & DISCLAIMERS

Despite being designed for quality & effectiveness, our products, while effective, are still an experimental technology, and can elicit a wide range of results due to differences in plant species-specific electro-magnetic sensitivities, soil health, environmental conditions, and so on.  Please see the section below for our implicit warranty and disclaimers that apply to all products in a general sense, with some sections specific to particular products.

Limited Warranty & Liability Indemnification

1. Warranty Scope

This limited warranty applies to the HarvestStorm Atmospheric Charge Collector "Antenna" made of FR4 PCB, including all components and mounting hardware (the "Product"), manufactured by Electric Fertilizer LLC (the "Manufacturer).

 

2. Warranty Period

The warranty period is 30 days from the date of original purchase.

 

3. Warranty Conditions

This warranty applies only when the Product is:

Used for its intended purpose and in accordance with the Manufacturer's instructions;

Properly installed, maintained, and inspected;

Not modified or altered in any way.

 

4. Exclusions

This warranty does not cover:

  • Damage caused by misuse, neglect, or accident;

  • Cosmetic damage or minor scratches;

  • Damage caused by extreme weather conditions, such as lightning strikes, hurricanes, rain, sleet, or hail;

  • Damage caused by third-party actions, such as vandalism or accidental damage from improper installation;

  • Normal wear and tear, like electrode corrosion over time.

  • Crop damage or loss due to excessive electricity during storms or other high-energy atmospheric events;

  • Crop damage or loss due to crop and ecosystem incompatibilities with this form of technology;

  • Any damage or injury caused by improper installation, including but not limited to:

  • Installation at too low of a height;

  • Failure to secure the Product to a stable and well-secured pole or mast;

  • Electric shock to plants or people;

  • Improper electrical installation;

  • Any other scenario that may result in harm to people or property.

5. Warranty Claims

To submit a warranty claim, please contact our customer service department via the contact form on the ElectricFertilizer.com website within the warranty period, with:

  • A detailed description of the issue;

  • Proof of purchase;

  • Any supporting documentation or evidence.

 

6. Remedy

The Manufacturer's sole obligation under this warranty is to repair or replace the defective Product, at its option, within a reasonable time.

 

7. Disclaimer of Liability

THE MANUFACTURER DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

 

8. Limitation of Liability

IN NO EVENT SHALL THE MANUFACTURER BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, BUSINESS INTERRUPTION, OR DAMAGE TO CROPS AND/OR PROPERTY.

 

9. Indemnification

The purchaser of this equipment (the "Purchaser") agrees to indemnify and hold harmless the Manufacturer, its officers, directors, employees, and agents, from and against any and all claims, demands, actions, or causes of action, arising from or related to the use of the Product, including but not limited to any damage or injury caused by improper installation or use.

 

10. Experimental Technology

The Purchaser acknowledges that the use of atmospheric electricity to improve plant growth is an experimental technology, and that the results may vary. The Manufacturer makes no representations or warranties regarding the effectiveness of the Product for this purpose.

11. Governing Law

This warranty shall be governed by and construed in accordance with the laws of the State of Missouri and the federal laws of the United States.

 

12. Binding Arbitration

Any disputes arising from this warranty shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

By purchasing and using the Product, you acknowledge that you have read, understand, and agree to be bound by the terms and conditions of this warranty & liability statement.

This limited warranty applies to all HarvestStorm products & prototypes, including the HarvestStorm Atmospheric Charge Collector "Antenna", including all components and mounting hardware (the "Product"), manufactured by Electric Fertilizer LLC (the "Manufacturer).
